![]() The Crag Law Center --- Fair & Balanced Implementation of Measure 37 & Transition to Measure 49 Early on, the Crag Law Center was asked by local citizens to help with the fair and balanced implementation of Measure 37. Since Measure 37's passage, the Center identified systemic problems with the policies contained in the statutory changes known as Measure 37. LEGAL ISSUES. Since the law's passage in 2004, the Crag Law Center has been assisting individual neighbors and groups across Oregon. There are currently many undecided legal issues under Measure 37 and the Crag Law Center is at the forefront of ensuring fair and balanced implementation of the law for Oregonians across the state. The legislature referred HB 3540 (Measure 49) to the voters. The voters resoundingly passed this change to Measure 37. Measure 49 law is designed to ameliorate the worst abuses of Measure 37, and Oregonians decided on November 6, 2007 to support this change. VESTING. The Crag Law Center continues to provide guidance to citizens who are working to ensure the fair and balanced implementation of Measure 37. Now that voters have approved Measure 49, the Crag Law Center has prepared two new guidance documents for its clients and for the general public - a memorandum on vesting dated November 9, 2007 and a memorandum on applicable law under Measure 37 dated November 9, 2007. These two memorandum have been made available to inform the public and local and state decision makers. These two interpretative documents are available in the Citizen's Comment Guide Directory. COMMENTING. Prior to the passage of Measure 49, concerned neighbors and citizens were seeking to provide comments to their local governments on development applications. To assist these individuals the Crag Law Center has prepared a Citizen’s Comment Guide to provide guidance in this process. The Guide and relevant attached documents will assist citizens in their efforts to comment in a timely fashion and can be found in the Citizen's Comment Guide Directory. This directory contains a detailed Citizen’s Comment Guide that provides an in-depth look at the issues involved in M37 development applications and an abbreviated version of the same guide. This directory also contains four sample comment letters, the text of Measure 37, a letter and exhibit from land use expert Ed Sullivan, and two memos by the Crag Law Center: the first on vesting (July 24, 2007) and the second on historic law (September 2007).
